Terms of Use

Before visiting or using the pages and the services of GRACE CHARITABLE FOUNDATION’S Internet site, henceforth GCF, the visitor should read carefully the terms and conditions described below (hereinafter ‘the terms and conditions’) governing the full contents (hereinafter ‘the contents’) of, and the use and supply of services through, GCF’S Internet site.

Unless the visitor  disagrees with the terms and conditions, in which case he/she shall not visit/use the pages of GCF’S Internet site the visitor  shall be deemed to be aware of the terms and conditions and to consent to them. GCF is entitled to amend the terms and conditions at any time. The visitor   shall each time check the terms and conditions for amendments as above and, in the event that he/she disagrees, he/she shall cease to visit/use GCF’S Internet site.

Should the visitor   continue to visit/use GCF’s Internet site, he/she shall be deemed to acknowledge and agree to the terms and conditions, as currently applicable.

The visitors acknowledge they have read the present terms, agree with them and undertake to comply with them.

Intellectual rights

The contents of GCF’s Internet site, including, without limitation, texts, news, graphics, drawings, photographs, illustrations, pictures, services supplied and generally records of any nature are protected by copyright and are, except for any expressly acknowledged third party rights, governed by national and international copyright law. Accordingly, the contents may not be reproduced, republished, copied, stored, sold, relayed, distributed, published, executed, downloaded, translated or modified in any manner whatsoever, in part or in summary form, without the prior express written consent of The GCF. Individual parts of the contents may exceptionally be stored or copied on an ordinary personal computer, on condition that the source of any individual parts of the contents stored or copied as above is cited at all times where they are intended solely for personal use, any commercial or other use or exploitation being prohibited. This clause shall under no circumstances be construed as an assignment or transfer of GCF’s intellectual rights in any manner whatsoever. Whatever else is contained in the electronic pages of GCF’s Internet site and constitutes an established trademark or product protected by a third party’s copyright falls within the third party’s area of responsibility and is therefore not included within the scope of this Agreement. Namely we would like again to inform you on the following topics:

  1. Ownership of trade names, domain names and trademarks

The website’s trade names, trademarks and domain names are owned by the GCF. The GCF reserves the right to initiate civil, administrative and criminal proceedings against any violations of the relevant terms concerning the use of the above mentioned assets.

  1. Intellectual Property Rights

All graphs, intellectual property programs, texts, icons, original photos as well as the website layout are owned by the GCF. You agree that GCF owns all rights, title and interest in the GCF (including, but not limited to, any computer code, themes, objects, characters, character names, stories, dialogue, concepts, artwork, animations, sounds, musical compositions, audiovisual effects, methods of operation, moral rights, and documentation). You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the website. The GCF reserves the right to initiate civil, administrative and criminal proceedings against any violations of the relevant terms concerning the use of the above mentioned assets.

III. The sui generis intellectual property right for the database

With regard to the website’s database, the company is the “creator of the database” and therefore has sui generis rights to this database in accordance with article 45A of Law 2121/1993 and the relevant European Community Institutional Framework. In this framework, the export and/or reuse of the whole or of a substantial part of the database, regardless of the protection of the base in accordance with the general provisions on intellectual property, is prohibited. Moreover, the repeated and systematic export and/or reuse of insubstantial parts of the content of the database that affects the normal use of said database by the GCF is prohibited. The GCF reserves its right to initiate civil, administrative and criminal proceedings against any violations of the relevant terms concerning its sui generis right on the database.

Visitor’s obligations

The visitor   shall comply with the provisions of national and International law and the relevant statutory provisions governing telecommunications, and shall refrain from any misuse or abuse of the contents of GCF’s internet site. Furthermore, the visitor  shall visit the site in a fitting and appropriate manner and shall duly observe the rules of Netiquette. Any damage caused to GCF’s internet site or generally to the internet by reason or as a result of the visitor ‘s misuse or abuse of the relevant pages shall fall exclusively within his/her area of responsibility.

Limitation of liability of CHARIS CHARITABLE FOUNDATION’S Internet site

The GCF undertakes to exercise its best efforts to ensure, but makes no warranties and is therefore not liable for, maximum accuracy, clarity, timeliness, completeness, correctness and availability of the information and the contents of GCF’s Internet site. Under no circumstances, including negligence, shall any liability be created in The GCF for any damage caused to the visitor   by reason or as a result of the use of GCF’s Internet site. Any information and service available through GCF’s Internet site shall be supplied ‘as is’, without any warranty whatsoever, whether express or implied, on GCF’s part, The GCF expressly disclaiming all warranties, even warranties regarding the merchantability or fitness thereof. The GCF under no circumstances guarantees an uninterrupted, error-free or virusfree supply of contents and services via GCF’s Internet site or via any other site server providing access to the contents of GCF’s Internet site. Accordingly, under no circumstances shall The GCF be liable for any direct or consequential damage, loss of profit, that may arise from the use of GCF’s Internet site.

Disclaimer of liability for solicitation

Under no circumstances shall any thing available to the visitor   through GCF’s Internet site be deemed to constitute a direct or indirect solicitation to carry out any donation or other act which has a financial impact; the visitor   shall use his/her discretion to assess anything available through GCF’s Internet site as above and shall act on the basis of his/her own will, without any responsibility on the part of The GCF. Links to other sites GCF’s Internet site is not legally responsible for the contents and services of Internet sites other than GCF’s which are accessible via GCF’s Internet site through links, hyperlinks or commercial banners, and makes no representations or warranties as to the availability of the contents or services thereof. Any problem which may arise during the visitor ‘s use of any other internet sites accessible via GCF’s Internet site falls within their area of responsibility and shall be taken up with them. Access to other Internet sites via GCF’s Internet site is provided for the visitor’s convenience only and creates no liability, obligation or commitment of any nature whatsoever in any of the parties involved.

Indemnification

It is hereby expressly agreed that in the event that any claim or action, whether administrative or judicial, is filed against GCF’s Internet site by reason or as a result of the visitor  ‘s breach of any nature whatsoever, the visitor   undertakes to enter a caveat and to indemnify GCF’s Internet site for any loss, damage or other expense incurred to it by reason or as a result of the above.

Governing law and other provisions

This Agreement is governed by the provisions of EU law, and relevant international provisions, and shall be construed in accordance with the rules of good faith, equitable principles and the economic and social purpose of the right. Should any of the terms hereof be declared contrary to the law and therefore void or voidable it shall ipso jure cease to be effective, but the remaining terms hereof shall under no circumstances be affected and shall continue to remain in full force and effect. No amendment to any of the terms hereof shall be valid or constitute a part hereof unless it is formulated in writing and incorporated into this Agreement. Any dispute arising hereunder shall be subject to the competent jurisdiction of the Athens – Greece courts.
